Terms of Service

1. Acceptance of Terms

By calling, texting, or otherwise interacting with a phone number operated by Ground Control IP LLC ("we," "us," "our"), including but not limited to branded vanity toll-free numbers such as 866-SEALCOAT, 877-MULCHMAN, and similar numbers, you ("you," "caller," "user") agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately.

2. Description of Services

Ground Control operates branded vanity toll-free numbers that connect homeowners and property managers with licensed, pre-qualified local contractors. When you call a Ground Control number, your call may be answered by an AI-powered voice agent. The agent may perform the following functions:

• Call answering and routing. The AI agent answers inbound calls, asks qualifying questions about your project, and routes your call to the licensed local contractor serving your area.
• Lead qualification. The agent may ask about the nature of your project, property location, timeline, and scope to determine the appropriate local contractor for your needs.
• SMS messaging. During or after a call, the agent may send you a text message (SMS or MMS) requesting photos of your property or project, confirming your appointment, or providing follow-up information. Standard message and data rates may apply. Message frequency varies.
• Appointment scheduling. The agent may offer to schedule an estimate or service appointment on behalf of the local contractor.
• Information collection. The agent may collect your name, phone number, email address, property address, and project details to relay to the local contractor.

3. SMS and Text Messaging Terms

By providing your phone number during a call or interaction with our AI agent and consenting to receive text messages, you expressly agree to receive SMS and/or MMS messages from Ground Control and/or the local contractor serving your area. These messages may include:

• Requests for photos of your property or project
• Estimate or appointment confirmations and reminders
• Follow-up information related to your inquiry
• Service-related notifications

Opt-out: You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. You will receive a single confirmation message, and no further messages will be sent unless you re-consent.

Consent to receive text messages is not a condition of purchasing any goods or services from the contractor or from Ground Control.

4. AI Disclosure

You acknowledge and agree that calls to Ground Control numbers may be answered by an AI-powered voice agent, not a human. The AI agent is designed to assist with call handling and contractor routing. While the agent is trained to be helpful and accurate, it is an automated system and may occasionally misunderstand or provide incomplete information.

If you prefer to speak with a human representative, you may request a transfer at any time during the call, and the agent will attempt to connect you with the local contractor or available staff.

5. Call Recording and Monitoring

Calls to Ground Control numbers may be recorded and/or monitored for quality assurance, training, and service improvement purposes. By continuing a call after being notified that the call may be recorded, you consent to such recording. If you do not consent, you may disconnect the call at any time.

6. Contractor Relationship Disclaimer

Ground Control IP LLC connects callers with independent local contractors. Ground Control does not employ, supervise, or control any contractor. Ground Control does not guarantee the quality, timeliness, or outcome of any work performed by a contractor. Any agreement for services is between you and the contractor directly. Ground Control is not a party to that agreement and assumes no liability for the contractor's work, pricing, or conduct.

7. User Conduct

You agree not to use our services for any unlawful, abusive, threatening, or fraudulent purpose. You agree not to attempt to interfere with, disrupt, or gain unauthorized access to the AI agent or any related systems. You agree to provide accurate information during your interaction with the agent.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." GROUND CONTROL IP LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE AI AGENT WILL BE ERROR-FREE, UNINTERRUPTED, OR AVAILABLE AT ALL TIMES. WE DO NOT GUARANTEE THE AVAILABILITY, QUALITY, OR LICENSING STATUS OF ANY CONTRACTOR.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROUND CONTROL IP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOST REVENUE, PROPERTY DAMAGE, MISSED APPOINTMENTS, OR DISSATISFACTION WITH CONTRACTOR WORK. GROUND CONTROL IP LLC'S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Third-Party Services

Our services rely on third-party platforms and carriers including, but not limited to, Twilio, Vapi, ElevenLabs, and various telephony carriers. Ground Control is not responsible for any service interruptions, message delivery failures, or data issues caused by these third-party providers.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising under these terms shall be resolved in the courts of the State of New Jersey.

12. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective when posted. Your continued use of our services after any changes constitutes acceptance of the updated terms.
